1          Promotion Rules

 

1. The following rules apply to the Solve It! Promotion (the ‘Promotion’) which will run from 09:00 on Monday 17th May 2021 until 23:59 on Wed 9th June 2021 on Digitalinfluencers.ie (the ‘Website’). Entries submitted after this time will not be included in the Promotion. All times will be based on Greenwich Mean Time.

2. The Promotion is run by Exterion Media (Ireland) Ltd (‘Global’) and in these rules, we refer to this company as ‘we’, ‘us’ or ‘Global’.

3. Anyone who enters the Promotion (the ‘Entrant’) will be deemed to have read and accepted these Rules and will be bound by them.

 

2          Details of the Promotion

 

2.1       To enter the Promotion, you must try to solve six puzzles displayed on Iarnróid Éireann (Irish Rail) LED Bridges (digital) at Pearse Street, Amiens Street, Drumcondra and North Strand in Dublin Ireland. You must then go online to the Promotion entry page at the Website, register your details and submit your answers. All Entrants will be submitted into a free prize draw.

2.2       There is no charge to enter the Promotion, no fees are payable, and no purchase is necessary.

2.3       After the closing time of the Promotion, 10 winning Entrants will be selected at random from all eligible entries. The 10 winning Entrants will be contacted by a representative of Global via email within 14 days of the close of the Promotion.

2.4       To claim the Prize (as defined below), the winning Entrant must respond to the email within 14 days and follow the instructions provided.

 

3          Eligibility

 

3.1       Entrants must be aged 18 or over and must be resident in the Republic of Ireland.

3.2       Entry is restricted to one entry per person; duplicate entries will be excluded from the Promotion.

3.3       Employees, directors, agents, consultants or subcontractors of Global or any company within the same group of companies as Global Outdoor Media Limited; and their immediate family members are excluded from entering the Promotion.

3.4       If you are ineligible to take part in the Promotion, your entry cannot be transferred to anyone else.

3.5       We cannot guarantee entry for mis-spelt, corrupt or ineligible entries. Entries received outside of the opening and closing times of the Promotion will not be accepted. We accept no responsibility for entries that haven’t reached us – for example, online entries not received as a result of network incompatibility, technical faults or for any other reason.

 

4          Prize

 

4.1       10 winning Entrants will each receive a €100 One for All Gift Voucher (online digital) (the “Prize”).

4.2       Each Prize is subject to availability and is non-transferable, non-refundable and no cash alternative is available. The Prize must be used by the date specified on the voucher or by the voucher supplier.

4.3       We will, of course, try to provide the Prize as described. Occasionally, circumstances beyond our reasonable control might make this difficult or impossible.  If we consider it necessary or appropriate, a Prize or Prizes (or part thereof) might be varied or swapped for a suitable alternative of equal or greater value, in our absolute discretion.

4.4       Prizes will be sent to the winning Entrants via e-mail. We will not be liable for any Prizes which are lost, delayed, damaged or destroyed.

4.5       If you fail to claim the Prize within the time-limit or fail to comply with any other instructions or time-limits notified to you or if you provide us with incorrect or fraudulent information, you will forfeit your right to the Prize. We will then select an alternative winner. If you are unable to provide us with a valid form of ID and/or proof of age or email address upon request, we reserve the right to withdraw the Prize and select another winner.

4.6       You will not be entitled to receive a prize which, for any reason, you would be prohibited by law from purchasing, using, owning or possessing. 

4.7       Any tax or other charge payable in conjunction with the prize will be the sole responsibility of the winner. If this is of concern you should speak to a financial advisor.

4.8       If the Prize has its own terms and conditions which apply, you will be bound by the same.  

 

5          Publicity and identity of winners

5.1       We may publish and publicise the first name and nearest city or town of all winners of the Promotion and we may refer to your association with the Promotion and/or the Prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion.  

5.2       You must not publicise your involvement in the Promotion (including giving interviews) without our prior written consent.

5.2       You confirm to us that

5.2.1    your entry will not violate any applicable law or regulation;

5.2.2    your entry will not contain anything which is indecent, untrue, defamatory, unlawful, hateful, threatening, demeaning, inappropriate, obscene, malicious or which is in contempt of court;

5.2.3    your entry will not cause any kind of harm or damage and does not (to the best of your knowledge or belief) contain any virus, malware, spyware or similar; and

5.2.4    you will indemnify us for any loss, damage or liability arising out of a breach of these clauses.

 

6          Data Protection

6.1       Your personal data will be collected and processed by us and if applicable, our service providers, network operators and suppliers in order to administer and fulfil the Promotion.

6.2       By entering the Promotion, you agree to all use, transfer and processing of personal data as set out above and in our privacy policy located at https://www.exterionmedia.com/ie/legal/privacy-policy. We will not use your contact details for any marketing purposes.

6.3       You may remove your personal details from our database by contacting Antoinette.ocallaghan@exterionmedia.ie. If you request that your personal details be removed prior to the conclusion of the Promotion, you will forfeit your right to claim any prize and we will select an alternative winner.

 

7          Liability

7.1       Your entry or participation in the Promotion and/or the use of the Prize is at your own risk. If the Promotion or Prize requires that you undertake any physical activity please ensure, before entering the Promotion, that you are in good health. You must take all reasonable steps to act as safely as possible when looking for information in relation to the Promotion, on and around the relevant LED Bridges.  If you have a disability, please make this clear to us when you claim the Prize, so we can consult with you well in advance of us delivering the Prize and make such reasonable adjustments as are practical and within our reasonable control, based on all the circumstances, to ensure that you can enjoy the Prize to the fullest extent.

7.2       If we consider that you or your entry are in breach of these terms and conditions, or if we have grounds to suspect any Entrant or third party of cheating, deception or fraudulent or unsportsman-like conduct of any kind (including, without limitation, manipulating the Promotion, choice of prize winners or any entry), without limiting the options available to us, we reserve the right in our sole discretion (and without us incurring any liability) to disqualify any entrant, entry or person we reasonably believe to be responsible for, or associated with, such activity. We also reserve the right to disqualify you from the Promotion and/or Prize (without us incurring any liability) if in our reasonable opinion you conduct yourselves in a way which is abusive or which exposes you or others to any medical, security, safety or similar risk whatsoever (including if you are intoxicated or abusive in any way). You agree that you will not do anything which is likely to bring us or any company within the same group of companies as Global Outdoor Media Limited into disrepute or which might adversely affect our reputation or the Promotion. If you are disqualified, the Prize may be withheld or withdrawn. You will not be compensated, and you may be required to pay any costs incurred.

7.3       Save that nothing in these terms and conditions limits or excludes our (or any third party’s) liability arising from fraud or from death or personal injury caused by negligence or any other type of liability which may not be limited or excluded by law, to the fullest extent permissible by law, we (a) shall have no liability in relation to any act or omission of any third party and (b) exclude all liability to you and anyone else for any claims, costs, losses, including indirect loss, damage or harm of any kind arising from or in connection with the Promotion and Prize and your use or enjoyment of them.  

7.4       In no event will our total aggregate liability to you exceed the cost of the Prize. 

7.5       We cannot guarantee that the services or systems for entering the Promotion will be free from omissions or errors. Subject to the above, we do not accept any liability in relation to such services or systems.

 

8          General

8.1       We reserve the right to withdraw or amend the Promotion and/or these terms and conditions if we consider it necessary or appropriate to do so for reasons beyond our reasonable control (including but not limited to strikes, labour dispute, illness, act of God, natural disaster, adverse weather conditions, pandemics or epidemics, damage, fire, floor and/or storm, compliance with law or governmental order etc.) or if there has been a broadcasting or printing error, etc.  Any changes will be posted on the Website. 

8.2       You agree to keep confidential any information which you know or reasonably ought to know is confidential and which relates to us, our business, the Promotion or the Prize.

8.3       In the event of any dispute, our decisions are final, and no correspondence will be entered into.

8.4       These terms and conditions represent the entire agreement between you and us in relation to the Promotion and the Prize. The invalidity, illegality, or unenforceability of the whole or any part of these terms and conditions  does not affect the remainder of the terms  which will remain in full force and effect. These terms and conditions do not create any right or benefit enforceable by any third party.

8.5       The Promotion, and these terms and conditions, are governed by and shall be construed in accordance with the Laws of Ireland, and any disputes arising in connection with them shall be subject to the exclusive jurisdiction of the Irish courts.
